New Pima County Ordinance needed for Cell towers

Our Goals and Current Needs
GREAT NEWS!!!
A first draft of the new community-protective telecommunications ordinance for Pima County, funded by our community and written by attorney Andrew Campanelli, is nearly complete. Once finished, a summary of the key points will be presented to County officials, including the Board of Supervisors, explaining in detail how the new ordinance benefits both the residents of Pima County and Pima county government.
We are on our way to having greater community protection from inappropriate cell tower and wireless facility siting in Pima County!
A closer look… In Picture Rocks, area cell tower cases remain paused, reportedly because the developer understands their proposals will fail and be denied if pursued as they stand. The cell tower developer did not expect nor were they prepared for this level of community engagement and informed opposition. When we organize and act, we as a community can effect positive change!

Our Battle- How it Started
Our community in Picture Rocks Arizona, has been involved in a battle to oppose the permitting of an 11-story cell tower in our neighborhood since November 2022. This tower would sit just 100 feet from homes. Many such permit applications are popping up all over our community, with over 5 in our area alone and more coming. Site developers are in a hungry race for profits, submitting a series of boiler plate applications lacking in data and evidence, hoping to find easy landing spots for their cash generating infrastructure irrespective of a provable need for their services.

We chose to hire Andrew Campanelli, JD to represent our community in this fight. With over 31 years of experience in telecommunications law and thousands of cases litigated involving the Telecommunications Act of 1996, attorney Campanelli brings a depth of expertise and experience that makes him one of the top telecommunications attorneys in the nation. We could not have been happier with our choice.
New Jurisdictional Codes Needed
Attorney Campanelli also specializes in writing new jurisdictional codes. He has recognized that many local ordinances for wireless communication facilities are deeply insufficient and do not vest local governments with the broadest powers available to them under the law. As a result, communities are left vulnerable and unprotected. Local governments find themselves susceptible to lawsuits from the telecommunications industry, based on gaping loopholes and omissions in the code. Campanelli’s new customized robust code is a much needed remedy for this vulnerable situation.
Groundwork Has Been Laid
In 2021 meetings were held with Pima County, Andrew Campanelli and citizens. The County was very open to the idea of hiring attorney Campanelli to do a revision of a portion of the code. The County acknowledged the need for this change but needed the funding to come from the community in order that their position of neutrality be preserved; it was dropped. Two years later we are in an even greater need for new code with substantial changes. We will be presenting a new robust ordinance and are hopeful that it will be well received.
